He did a good job, but it appeared to me that he was not
fully into it. I think he was surprised that Elyse
actually went to trial.
They expected her to take a plea similiar to what Larry
Flynt did a few years ago.
They didn't even have an expert witness!
They avoided talking about the internet at all times.
Defense:
=======================================================================
H. Louis Sirkin and Jennifer M. Kinsley did an outstanding
job. They were well prepared and they put on 2 very good
expert witness.
They did a good job of switching on and off and taking turns.
They never once lost their cool. They had very good jury
interaction.
They were very calm and very professional!
They brought up the internet at the appropriate times.
Mr. Sirkin's closing comments about his flashlight and the
fact that you can:
* Turn it on
-or-
* Turn it off
was a good way to sum everything up.
Mr. Sirkin did an outstanding job!
Judge:
=======================================================================
Judge Robert P. Ruehlman did a very good job and was very
fair in all of his rulings.
He thanked the jury for their hard work and for coming
to a decision on all 3 counts.
On the way home I heard him make a comment on WLW radio
about new Community Standards and there will be fewer
of these kind of trials.
Jury:
=======================================================================
They did a real good job and it really was difficult to
sit and watch 4 hours and 14 minutes of adult tapes.
Then they had to try to figure a very confusing law. It is
obvious that they had to really struggle with their
decisions because of the amount of time it took.
They did a great service for the community and they should
be complimented.
Den's Comments:
=======================================================================
When I heard that the jury had reached a decision on 2 of
the counts and were leaning toward a hung jury on 1
count, I felt really good.
To me it meant that the 2 hetero tapes were okay and
the struggle was over the gay tape. Since they were
split on it, it meant to me that the worst case
scenerio was 2 Not Guilty and 1 Hung Jury.
And, the longer they continued to discuss it, it
could only be swayed to Not Guity.
Mr. Sirkin had his own theory on this and he thought it
was going to be 2 tapes okay and the Gangland #17 was
the tape in question.
Would love to have one of the Juror's talk about it.
Elyse has reported to Tod Hunter that one of the
Jurors visited her store and discussed the case
with her.
He said the tape in question was Gangland #17.
Mr. Sirkin is the MAN!
Did an outstanding job.
Elyse should be the toast of the town!
It took alot of guts to take them on and to
not accept the plea bargin.
And, she WON!
