05/15/2001  Court    Started at 10:30am with each side presenting
                       their opening statements.
                       
                       Defense's included history of Elyse Metcalf,
                       the defendant.

                     First Witness was called.
                       Undercover policeman with City of Cincinnati.
                       He visited store and purchased the video Aged
                       to Perfection #15 starring Kitty Foxx for his
                       'father' to view.

                       Requested that Elyse look into a Jeff
                       Stryker video for a 'friend' of his.

                       He returned to store a few weeks later
                       and Elyse got the tape for him. She kept
                       it under the counter in the special order
                       section.

                       He purchased Jeff Stryker Underground tape.

                     Cross Examination.
                       He testified on the store, the store layout
                       and the store inventory.

                       He did review the Kitty tape, but did not
                       review the Jeff tape.

                     Second Witness was called.
                       Undercover policeman from Hamilton County
                       Sheriff's office. He visited store one
                       day for approximately 5-7 minutes and
                       purchased Gangland #17.

                     Cross Examination.
                       He visited the store on his own free will.
                       No large signs outside the store to lure
                       him into the store to buy anything.
                       Reviewed the tape in his office.

                       He is part of the vice squad that checks
                       the entire county for pornography. He
                       visits Blockbuster Video and other Video
                       chains. He did not check out:
                         * Internet
                         * Hotels Pay for View offerings.
                         * Mail order offerings.
                         * Libraries.
                         * University of Cincinnati library


                     Evidence
                       They played the Kitty Foxx Aged to Perfection
                       tape to the jury.
                       Technology problems forced them to play
                       on 1 TV.

                     Lunch break at 1:50pm
                       I had lunch with Elyse and left for the day.

                     Schedule is to play the Jeff Stryker tape on
                       Tuesday afternoon and the Gangland tape on
                       Wednesday morning.

                       I will return mid morning on Wednesday.
